1. Agreement

By using our service, you confirm your acceptance of the terms and conditions outlined in this Agreement, which establishes a legal agreement between you and us. Failure to agree to any of these terms prohibits you from accessing or using any of the Services. Furthermore, you are not permitted to transfer, pledge, or assign any rights or obligations under this Agreement to a third party without our explicit written consent.

We reserve the right to transfer or assign this Agreement or any rights or obligations under it without your consent. Your consent to such future transfers or assignments is hereby granted. However, this does not affect your ability to deactivate your Account.

Each time you access or use the Service for a transaction, you must acknowledge and consent to the applicable charges and exchange rate, as communicated to you through direct means or via our website. By proceeding with a transaction, you affirm that you understand and agree to the communicated charges and exchange rate. If you do not comprehend or consent to the Charges and Exchange Rate, you may not proceed with a transaction.


To utilize our Service and create an Account, you must meet the following criteria:

  1. Possess full legal capacity to enter into a contract.
  2. Provide the requested documents and information to our compliance team or any other designated member of our team.
  3. If you are an individual, you must be at least 18 years old or older, or meet the applicable age of majority and contractual capacity in your jurisdiction if it exceeds 18 years of age. By accessing or using the Service, you represent and warrant that you are 18 years of age or older and possess the legal competency to enter into this Agreement.
  4. Unless you have authorization from your own company or the company you work for, you are prohibited from acting on behalf of or benefiting any other person. By creating an Account for a company, you confirm that you are authorized to represent that company.
  5. If you are using our Service on behalf of a legal entity, you assert that you have the authority to bind that entity to the terms of this Agreement. You may need to provide a Board Resolution or Letter of Authorization to verify this authority. The term "you" in these terms refers to both you as an individual and the entity you represent, and the entity is responsible for ensuring compliance with these terms for all users accessing the Services on its behalf.

Depending on regulatory requirements, we may impose restrictions or limitations on accessing or using our Service in specific locations or countries.

We reserve the right to amend or modify these terms by posting a revised version on our website and notifying you, if applicable. By continuing to access or use the Service after the revised terms are posted, you agree to be bound by the updated version. If you do not agree to these revised terms, you must deactivate your Account and discontinue using the Services.


Furthermore, we have the right to:

  1. Make changes or discontinue any part of the Service.
  2. Suspend or terminate your access to the Service at any time and without prior notice in certain specific circumstances outlined in this Agreement.

You acknowledge that we are not liable to you or any third party for any modifications or terminations of the Service, or for the suspension or termination of your access to the Service, except as explicitly stated in this Agreement.

2. Our Operational requirements

The availability of the Service is governed by the terms and conditions of this Agreement.

Once you have created an Account, you can initiate Transactions and provide us with payment instructions regarding fund deposits and proceeds from your transactions.

All Transactions are subject to approval and verification. In compliance with applicable laws and regulations, we may reject a Transaction. If a Transaction is rejected, we will notify you and provide reasons for the refusal, unless disclosure is prohibited by applicable regulations.

3. Terminal Transactions

In order to initiate a terminal transaction, you need to follow these steps:

  1. Create a trade request through your Account or other agreed-upon means of communication.
  2. Agree on an Exchange Rate with us, which will determine the amount of local currency to be transferred to us and the foreign currency to be paid out by us.
  3. Provide the necessary account details for the deposit of the foreign currency equivalent.
  4. Transfer the agreed-upon local currency to our designated account as provided by us on our website or through other communication channels.

Upon confirmation of receipt of the funds, you must confirm the transaction.Once you confirm a terminal transaction, you authorize us irrevocably to credit the provided account for settlement, and you cannot cancel the Exchange Transaction.We will notify you (and the recipient, if applicable) of the successful transfer of the funds.

If we deposit an amount in excess of the agreed designated amount, it will be considered an overpayment. Upon notification and instructions, you must refund the excess amount as directed.

If you fail to refund the overpayment, we have the right to set off and apply any or all of the designated amount you are entitled to in subsequent transactions to satisfy the overpayment, with or without notice to you and to the extent permitted by law.

We will attempt to verify the validity of the account provided for settlement, but it is your responsibility to ensure that the account belongs to the intended recipient. If we are unable to deliver the designated foreign currency to the provided account, our only obligation is to terminate the Transaction.

If we terminate the Transaction, our only obligation is to refund the amount of that transaction, unless we are legally required to hold the funds due to suspected risks of money laundering, illegal activities, online fraud, or other reasons mandated by applicable regulations. We reserve the right to refuse or cancel any pending transaction as required by law or in response to a subpoena, court order, or government directive.

You acknowledge that payments made by us may be completed within 48 hours or within a timeframe communicated to you. You accept the risk of possible transaction delays and agree to hold us harmless from any damages or injuries arising from such delays.

4. Account Opening

To utilize the Service, you must register as a customer on our website and create a designated Account. During the registration process and periodically afterward, you will need to provide the following information:

  1. Your full name
  2. Your residential address
  3. Your email address/phone number
  4. Your date of birth
  5. Your taxpayer identification number
  6. Your nationality
  7. A username and password
  8. Copy of your passport or other government-issued identification document
  9. A Board Resolution authorizing the creation of the Account and conducting transactions, or a Letter of Authorization if applicable
  10. Any additional information that our compliance team may request from time to time to verify your identity or that of your business

Symmetral Technologies will not render any type of services to customers located in any of the below listed prohibited countries. The prohibition also extends to directors and/or the beneficial owners located or from any of these countries, unless an exception is granted by the Compliance department of Symmetral Technologies. Please ensure that the information you provide for your Account is accurate and complete. It is your responsibility to promptly update any incomplete or incorrect information. The list of countries mentioned may change periodically based on our internal compliance measures.

We will carefully review and verify the information you provide. To assist in this process, we may engage third-party services, such as KYC scanning solutions and fraud management agencies, and access national databases. This helps us manage the risk of online fraud and fulfill our legal obligations as a payment services institution. For more information, please refer to our Privacy Policy.

The information you provide will be securely stored for a period of seven (7) years, or as required by applicable laws and business practices, for purposes of risk management, security, and record-keeping.

If you have previously attempted to create an Account using similar or identical information, we retain the right to decline the creation of a new Account. In such cases, you will be required to access and utilize your existing Account.

5. Taxes

All charges do not include taxes. It is solely your responsibility to determine if any taxes are applicable to the transactions conducted through the Service and to handle the withholding, collection, reporting, and remittance of the correct tax amounts to the relevant tax authorities.

We are not obligated to determine the applicability of taxes or duties, and we are not responsible for calculating, collecting, reporting, or remitting any taxes or duties to any authority related to the transactions

6. Privacy

Ensuring your privacy is of utmost importance to us. Please review our Privacy Policy, which is incorporated into these terms, to understand how we protect your privacy and use your information.If you receive information about another user through the Service, you must keep it confidential and only use it for Service-related purposes. You are not allowed to disclose or distribute a user's information to third parties without their consent, except as necessary for Transaction-related functions. Unsolicited emails to users are prohibited.

By using our Service, you agree to receive notices or communications electronically regarding your Account and the Service. This includes emails, SMS messages, telephone calls, or website postings. If you choose not to receive electronic communications, your Account will be deactivated.

We may disclose or receive your personal information or documents to/from law enforcement, regulatory agencies, service providers, affiliates, partners, lawyers, auditors, or courts, as necessary for legal, governmental, or regulatory purposes.You must comply with our instructions regarding the services. Your calls, emails, or SMS messages may be monitored or recorded for quality control, training, system security, and crime prevention purposes.

If you grant permission to a third party to access your Account, you remain responsible for any actions taken by that third party. We are not liable for any acts or omissions of third parties using your Account credentials, and you agree to indemnify us in such cases.
We are not obligated to determine the applicability of taxes or duties, and we are not responsible for calculating, collecting, reporting, or remitting any taxes or duties to any authority related to the transactions

7. Use of our Website

We grant you a limited license to access and use our website and its content solely for approved purposes. Unauthorized use is prohibited, and all rights to the website and content are reserved.

We may change or update information on the website without notice, and you are responsible for verifying and relying on the information.

Our website may contain links to third-party materials for your convenience, but we do not endorse or recommend them. We are not responsible for the content or services offered by third-party sites.

We advise using virus screening software and being cautious of spoofing and phishing attacks through SMS and email services. Always log into your Account through the website for authentic communications.

We reserve the right to suspend, restrict, or terminate services and deactivate or block Accounts without liability under certain circumstances. This includes compliance with legal requirements, suspicion of unauthorized or fraudulent activities, breach of agreement, or actions that may harm the services. System outages may result in temporary Account suspension, and we will deactivate your Account upon your request.

You must not use our services for illegal activities, and we may establish controls or conditions if excessive chargebacks, disputes, or irregularities occur. We may suspend services and block Account access if there are violations, security concerns, or unauthorized use.

We will inform you of Account suspension reasons, unless prohibited by law. We may reactivate your Account once the reasons for suspension are resolved. Deactivated Accounts may result in canceled transactions, limited access, and retaining of account information. We may retain your funds to mitigate risks, but you can receive undisputed funds after a reasonable period.

Certain actions regarding Account access may be based on confidential risk management and security criteria. We are not obligated to disclose these details.

8. Security and Authorization

You are only allowed to link one login and password to your Account. It is important that you do not reuse this combination for any other online service or website to ensure the security of your Account. Never share your Account credentials with third parties. You are responsible for all Transactions conducted using your login and password. We recommend changing your password regularly and using two-step authentication whenever possible.

You are responsible for maintaining the security and control of your login credentials, including logins, passwords, PINs, MFA identifiers, or any other codes used to access our Service. If you suspect unauthorized access, activity, or use of your Account, report it immediately to symmetraltechnologies@gmail.com.

Keep your email address and contact information updated in your Account to receive important notices and alerts from us. We are not liable for any losses resulting from compromised email credentials, loss of personal devices, or failure to act on the notices and alerts we send you.

Our representatives will never ask for your password. Any communication requesting your password should be considered unauthorized and suspicious, and should be forwarded to us for investigation.

If you choose to share your login credentials with a third party, even for additional services, such as account aggregation or information services, that third party will have access to your Account and personal information. You are fully responsible for any actions taken using your password and login credentials in such cases.

9. Processing Transactions

We have the right to establish and modify transaction limits at our discretion. All transactions from your Account will be carried out through authorized transfer instructions using your login and password or other approved methods.

You must ensure that you have sufficient funds in your Account to cover the value of any exchange transactions and associated charges. If you don't have enough funds, you cannot initiate such transactions.

We will verify and confirm all transactions through email or other designated communication channels. Our records will be considered accurate unless proven otherwise. We reserve the right to refuse or decline any transaction you submit, and we will communicate the reasons for the refusal and any steps you can take to proceed with the transaction.

We may refuse to execute a transaction in various situations, including if there are errors or incomplete details in the instructions, if you lack sufficient funds, if you breach your obligations, if you exceed established limits, or if there are security concerns.

If your transaction is inconsistent with your Account's history or stated purpose, we may request additional information or clarification from you before processing new transactions.

Please be aware that you will be liable for losses related to unauthorized transactions if you act fraudulently, provide false information about your identity or activities, or violate any other terms.

We will notify you of suspected or actual fraud or security threats via your registered email, phone number, or other communication methods as required by regulations.

10. Your Responsibilities

You agree to comply with applicable laws and regulations and provide necessary documentation. You are prohibited from engaging in certain activities, such as copying, selling, modifying, or exploiting our website content, or interfering with the Service or its users. Unauthorized access, infringement of intellectual property rights, and acting as a payment intermediary or reseller are also prohibited.

We reserve the right to monitor and disclose information as required by law. The use of the website, services, and content is at your own risk, and we provide no warranties or guarantees regarding their accuracy, reliability, or uninterrupted availability. We disclaim all warranties, including those of merchantability and fitness for a particular purpose.

We are not liable for damages caused by technological issues, such as viruses, or for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the site, services, or content. However, this limitation of liability does not apply to cases where it is prohibited by applicable law.

You agree to defend, indemnify, and hold us harmless from any claims, liabilities, damages, losses, costs, or expenses arising from your use of the services, violation of the agreement, or any transactions conducted through our website.

11. Other Provisions

This agreement is a legally binding contract that applies to you and your designated agents.

You are not allowed to assign or transfer this agreement to another person, while we have the right to do so. However, this agreement will still bind you and us, as well as our respective agents.

The failure or delay of either party to exercise a right or remedy under this agreement does not constitute a waiver of that right or remedy. Each party's rights and remedies under this agreement are cumulative and not exclusive, meaning they can still exercise other rights and remedies provided by law.

If any provision of this agreement is found to be invalid or unenforceable, it will not affect the validity and enforceability of the other provisions. The remaining provisions will continue to be in full force and effect.

You represent and warrant that any funds used in connection with the service are either owned by you or that you have valid authorization to perform transactions with those funds.

You are responsible for paying all expenses incurred by us in recovering any amounts you owe, including legal fees, collection fees, and tracing fees.

Our website, services, and all content, features, and functionality are owned by us or our licensors, and you do not acquire any rights to them. You cannot reproduce or make our website content available without our prior written consent.

The Symmetral Technologies logo and other trademarks on our website are owned by us or our affiliates or licensors, and you cannot use them without our prior written permission. Other trademarks on our website belong to their respective owners.

This agreement, along with the privacy policy, constitutes the entire agreement between you and us regarding the use of our website and services, superseding any prior agreements or understandings.

This agreement is governed by the laws of Nigeria. Any disputes will be resolved through arbitration under the Nigerian Legal system. Any cause of action or claim arising from this agreement must be commenced within one year, or it will be permanently barred.

Both parties are prohibited from engaging in money laundering or transactions with criminal elements. Each party must comply with applicable laws and regulations regarding money laundering and provide the necessary documentation and information. Any breach of this provision may result in indemnification for any losses suffered by the other party.

This agreement does not prevent either party from seeking urgent relief from a court of competent jurisdiction.

12. Definition of Terms Used

"Account": Refers to the account created by providing certain information and registering with us under this agreement.

"System": Denotes the proprietary service marketed, managed, and operated by us.

"Charges": Represents the fees deducted from your Account when you complete a Transaction.

"Customer": Includes you and any other person whose name is registered for an Account under the Service.

"Exchange Rate": Signifies the rate at which the transaction is consummated under this Agreement.

"Terminal Transaction": Refers to the transfer of a specified quantity of funds from you to us and the corresponding transfer to a designated account provided to us, excluding any applicable charges, as outlined in the terms and conditions.

"Service": Represents the service provided by us for a trade transaction, governed by the terms and conditions of this Agreement.

"Website": Refers to www.symmetraltechnologies.com, which serves as our online platform for conducting business. It also includes any other designated URLs we may specify for use with the service.

"Transaction": Refers to a Trade Transaction.

"Transfer Instructions": Refers to the instructions provided by the Customer through the Service for the transfer of purchased or exchanged Foreign Currency, as outlined in this Agreement.
